Terms of use

These terms apply to everyone using theOFL.app, run by Ben Nodwell trading as theOFL.app, Isle of Man ("theOFL", "we", "us"). By using the site, you agree to them. Questions: hello@theofl.app.

1. What theOFL.app is

theOFL.app is a local platform where Isle of Man businesses and community groups share spare availability, offers, listings and events, and where anyone can find them.

We're a listings platform. We're not party to any booking, purchase or arrangement between you and a business. Any agreement is between you and them.

2. Our promise on trust

Businesses may pay to be seen, never to be trusted.

  • We check every business and organisation before it appears publicly. Verification is free and can't be bought.
  • Paid plans and adverts buy visibility only (more listings, promoted placements and banner adverts). They never affect verification, and paid placements are always clearly labelled.
  • A listing, advert or verified badge isn't an endorsement or guarantee by us.

3. Accounts

  • You must be 18 or over to create an account.
  • Give accurate information and keep it up to date.
  • Keep your password safe. You're responsible for what happens on your account.
  • One account per business or organisation, unless we agree otherwise.

4. Verification

  • We verify businesses and organisations by hand, in the way we decide is appropriate.
  • Until you're verified, your listings and events won't show publicly.
  • We can decline, pause or remove verification at any time if we have concerns, for example about accuracy, conduct or complaints.

5. What you post

You're responsible for your profile, listings, events, photos and any other content you add. It must:

  • be accurate, and honest about prices, availability and conditions;
  • be lawful, and follow advertising and consumer protection rules;
  • only include photos and material you own or have permission to use;
  • not be offensive, discriminatory, misleading or spam.

You keep ownership of your content. You give us permission to display, resize and share it on theOFL.app and in promoting theOFL.app, for as long as it's on the site.

We can edit, hide or remove content, or suspend accounts, that break these terms or that we reasonably think could harm users or theOFL.app.

6. Plans and payments (businesses)

  • Plans are monthly subscriptions, billed through Stripe. Prices are shown on our Pricing page, including any VAT that applies.
  • Your plan renews automatically each month until you cancel. You can cancel at any time, and your plan stays active until the end of the period you've paid for.
  • If a payment fails, we'll try again and let you know. Your plan continues while we retry. If payment can't be collected, the plan ends and your account moves to the free tier. Your existing listings stay up until they expire.
  • Payments aren't refundable, except where the law says otherwise.
  • We may change prices with at least 30 days' notice. Changes apply from your next billing period.

7. Adverts

  • Banner adverts and promoted listings are always labelled as paid.
  • Advertisers are responsible for their adverts being accurate and lawful.
  • We can refuse or remove any advert.

8. Using the site fairly

Don't:

  • misuse, scrape or overload the site;
  • try to access accounts or data that aren't yours;
  • impersonate a business or person;
  • use theOFL.app to send spam or collect other people's details.

9. Our liability

  • We work hard to keep theOFL.app running and accurate, but it's provided "as is". We can't guarantee it will always be available or error-free.
  • Businesses are responsible for their own listings, offers and services. We're not responsible for what happens between you and a business.
  • To the extent the law allows, we're not liable for indirect losses, or for losses caused by a business, user or third-party service. Our total liability to a business is limited to the fees it paid us in the previous 12 months.
  • Nothing in these terms limits liability that can't legally be limited, such as for death or personal injury caused by negligence, or for fraud.

10. Ending your account

You can close your account at any time by emailing hello@theofl.app. We can close or suspend accounts that break these terms. Our Privacy policy explains what happens to your data.

11. Changes

We may update these terms. If the changes are significant, we'll tell account holders by email before they take effect.

12. Law

These terms are governed by the laws of the Isle of Man, and the Isle of Man courts have jurisdiction.
